What is litigation? Litigation is a legal court hearing that involves two people in which one is defending and the other is enforcing. In a legal court proceeding, one party is the plaintiff and the litigator represents the plaintiff. The litigator oversees the whole litigation process from start to finish. At first, media coverage about the hullabaloo makes it all sound like a very sexy airport thriller involving exotic lands, complex financial deals, and wealthy people. The truth, however like most things related to tax, is a bit mundane.

First, let us first deal with the elephant in the room. The reality is that New Zealand is not and will never be a tax haven. The OECD regularly maintains a list of its tax havens but New Zealand does not, never has and is unlikely ever to feature on it. The major characteristics of tax havens are that they enforce none or only minimal taxes. Also, there is a lack of transparency, and laws or procedures hinder the exchange of information with foreign governments. We do not qualify on any of these grounds nor do we house a highly secretive private banking sector.

The standard for transparency is the proverbial 2002 OECD Model Agreement related to the Exchange of Information regarding Tax Matters. It also supports the international exchange of information for managing or imposing domestic tax laws. New Zealand was among the first countries to be included in the OECD’s white list for having considerably implemented the internationally established tax standards. One means in which this country has demonstrated leadership in transparency is how it manages foreign trusts and the imposed placed on trustees. All of these go towards assisting foreign governments that request important information.

Geoffrey Cone graduated from the University of Otago, New Zealand, with an LLB and a post-graduate diploma in tax together with trust law. He commenced the practice in 1980 in Auckland, New Zealand and later moved to Christchurch. Here, he was a partner together with the Chairman of Partners in the leading law firm.
